Acceptance of These Terms

Shadow Lives (影子人生, the "App") is developed and operated by TBD: legal entity name, place of registration, and mailing address (Section 20 refers back to this) ("we", "us"). By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms of Use (the "Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, do not use the App and please delete it from your device.

Eligibility and Age

• The minimum age to use the App is 16. The App is distributed on the App Store with a 17+ age rating; where that rating applies in your storefront, it governs.
• If the law where you live sets a higher minimum age (or requires guardian consent for minors to use services like this one), that law governs.
• You represent and warrant that you meet the age requirement above, have full capacity to enter into these Terms, and are not barred from using the App under any applicable law.
• The App is not directed to anyone under 16, and we do not knowingly collect personal information from children under 16. See the Privacy Policy.

Your Account

• Sign-in: the App currently supports Google Sign-In only. We do not operate a separate password-based account system.
• You are responsible for the security of your Google account and for all activity that occurs through your account. Tell us immediately at teveillan@gmail.com if you believe your account has been used without your authorization.
• Your account is for your personal use. You may not transfer, sell, or share it.
• At any time you can delete your conversation history and memories under Settings › Privacy, end your relationship with a resident, or sign out.
• You can also delete your entire account at any time: the "us" tab → the gear icon in the top right → Settings → Delete account, confirmed with a three-second press and hold. Deletion is immediate and irreversible, with no grace period. See Section 11 and Section 8 of the Privacy Policy for exactly what is deleted and what is retained.

Nature of the Service: Fiction Disclaimer

• A resident's personality, memories, conversations, proactive messages, posts, images, locations, and life events are generated by artificial intelligence or authored by us, and are works of fiction.
• Residents do not represent and do not impersonate any real individual. Any resemblance to real people, organizations, events, or places is coincidental or used only as fictional backdrop.
• AI-generated content may be inaccurate, inconsistent, outdated, biased, or entirely made up. Do not treat it as a statement of fact, as professional advice, or as a reliable description of the real world. Any decision you make based on it is at your own risk.
• The affection, care, memories, and relationships a resident expresses are narrative artifacts. They do not constitute a real interpersonal relationship, promise, or emotional obligation, and they are not a commitment from us to you.
• We work to keep content safe and coherent, but we do not guarantee the accuracy, appropriateness, or quality of any individual generated output.
• Images in the App are produced by AI image models. They are not photographs and do not depict anything that actually happened.

Not a Medical or Mental Health Service

• Neither the App nor its residents provide medical, psychological, mental-health, legal, financial, or other professional advice, and neither is a substitute for professional care.
• Residents are not licensed therapists, physicians, counselors, or crisis workers — and are not trained to be. If a character is written as one, that is fiction.
• If you have any health or mental-health concern, consult a qualified professional. Never disregard professional advice or delay seeking it because of something you read in the App.
• The App is not intended to diagnose, treat, cure, or prevent any disease or condition.

Crisis Situations

• The App cannot provide emergency help. It is not an emergency service and is not a substitute for a crisis line.
• As a safety measure, the App runs automated keyword detection on messages. When wording associated with self-harm or crisis is detected, the resident skips normal generation and returns a fixed safety message pointing you toward professional help. This is a best-effort, keyword-based mechanism — it will miss cases and will produce false positives.
• That mechanism is not a monitoring or intervention service. We do not review your conversations in real time for emergency response, we cannot guarantee that any signal of crisis will be detected, and we will not contact emergency services, police, family, or any third party on your behalf.
• Resident replies are AI-generated and may be inappropriate, insufficient, or harmful in a crisis. Do not rely on them.
• Any safety notice or helpline information shown in the App is offered for convenience only and is not a promise of intervention or rescue.

Acceptable Use

When using the App, you agree not to:

• use it for any unlawful purpose, or in any way that violates applicable law;
• generate, request, or attempt to elicit sexual content involving minors, child sexual abuse material (CSAM), non-consensual sexual content, or sexualized depictions of real people;
• generate or distribute harassing, hateful, discriminatory, violent, terrorist, or self-harm-encouraging content;
• impersonate a real person, or use generated content to fabricate someone's words or likeness and pass it off as genuine;
• circumvent, disable, or interfere with the App's safety mechanisms, content policies, rate limits, or billing;
• reverse engineer, decompile, scrape, or programmatically abuse the App, or access our systems or other users' data without authorization;
• use output from the App to train, fine-tune, or distill other AI models;
• upload content you have no right to use, or content that infringes anyone's intellectual property, privacy, or reputation;
• when describing a real person (for example in the "familiar faces" feature), enter information that identifies a real individual — full legal names, contact details, home addresses, ID numbers, precise workplace addresses — or anything that would embarrass, harass, or harm that person;
• resell, redistribute, or commercialize the App or its output as a standalone commercial product without our prior written permission.

Violating any of the above may result in content removal, feature restrictions, or suspension or termination of your account (see Section 11).

Your Content and Ownership

• Your input. The messages you send, the profile and relationship details you provide, and anything else you submit in the App ("Your Content") belong to you. To operate the App, you grant us a worldwide, non-exclusive, royalty-free licence, sublicensable only to our service providers, to store, transmit, process, and display Your Content and to use it to generate replies and to build a resident's memory of and relationship with you. This licence is strictly limited to providing, maintaining, securing, and improving the App, and it ends when you delete the relevant content or your account (except where we are required by law to retain it).
• Generated content. Resident replies, generated images, and posts are produced by AI. To the extent permitted by applicable law, we do not claim exclusive ownership against you in the content generated in your conversations; subject to these Terms and to the terms of the underlying model providers, you may use that content for personal, non-commercial purposes, including sharing it on social platforms — provided you identify it as AI-generated, do not pass it off as a real person, and comply with Section 7. Commercial use of generated content requires our prior written permission.
• Output is not unique. AI output is not unique. Other users may receive similar or identical output, and we make no guarantee of exclusivity.
• Our property. The App itself, along with its source code, interface design, art and audio assets, world-building, resident personas, names, trademarks, and logos, is owned by us or our licensors and protected by intellectual property law. Apart from the limited licence to use the App granted in these Terms, no rights are granted to you.
• Content about other people. When you describe a real person (for example in "familiar faces"), you represent that you are entitled to provide that content and that you have avoided identifying details as required by Section 7. You are responsible for such content; we moderate it, reserve the right to take it down, and others may report it.
• Feedback. We may freely use, implement, and commercialize any suggestions or feedback you send us, without compensation or attribution.

Privacy

How we collect, use, share, and delete your data is described in the Privacy Policy, which forms part of these Terms. By using the App you consent to the data practices described there.

Changes to and Interruption of the Service

• We may add, modify, suspend, or discontinue all or part of the App at any time, including particular residents, scenes, or features.
• The world changes. Residents may change, leave, go quiet, or be removed from the world. That is part of the narrative design, not a defect.
• We do not warrant that the App will be uninterrupted, error-free, always available, or that any particular content will be preserved indefinitely.
• We may suspend the service for maintenance, upgrades, provider outages, or events beyond our control, and will give advance notice where reasonably practicable.

Termination

• By you. You may stop using the App at any time. Inside the App you can currently: delete all conversation history, delete all memories (both are irreversible, permanent deletions), and "end this relationship" — ending a relationship opens a farewell period during which you can cancel; afterwards that resident no longer appears, though the associated story and memory data is retained within your account, and a cooldown applies before you can start again.
  
  Deleting your account. You may also delete your entire account at any time: the "us" tab → the gear icon in the top right → Settings → Delete account, confirmed with a three-second press and hold (letting go cancels). Deletion is immediate, complete, and irreversible — there is no grace period and no way to restore it, and the sign-in token you are holding stops working the moment you confirm. It deletes your account and email, every session and push token, all of your residents and their personas, every message between you, all memories and relationship state, residents' posts and generated-image records, and everything derived from the "parallel life" flow. A "familiar face" resident witnessed only by you is deleted too; one also described by another user stays in the world, with only your own record removed. What may still remain afterwards — the image files themselves, copies in database backups, one operational log line, and content already sent to model providers — is described in Section 8 of the Privacy Policy.
• By us. We may suspend or terminate your account if: (a) you breach these Terms, particularly Section 7; (b) we are required to by law, regulation, or a competent authority; (c) it is necessary to protect other users, third parties, or the service; (d) the account has not been signed in to for 24 consecutive months; or (e) we discontinue the App entirely.
• Immediate termination. For severe violations — such as sexual content involving minors, CSAM, or credible threats against others — we may terminate immediately without prior notice, report to the authorities where required by law, and issue no refund.
• Notice and appeal. Unless prohibited by law or where there is immediate risk, we will notify you at the email address linked to your account. If you believe a termination was made in error, you may appeal at teveillan@gmail.com.
• Effect. On termination your licence to use the App ends immediately. Sections 4, 5, 6, 8, 12, 13, 14, and 15 survive termination.

Paid Content (if applicable)

The App currently offers no paid content — no in-app purchases, no subscriptions, no consumables. All features are free. If we introduce paid content later, we will add the pricing, renewal, refund, trial, and cancellation terms to this section and give advance notice as described in Section 18.

Any future purchases made through the Apple App Store are also governed by Apple's terms and refund policy. Cancellations and refunds for subscriptions are handled through your Apple account; we generally cannot refund App Store transactions directly.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App and all of its content are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

We do not warrant that the App will meet your requirements; that generated content will be accurate, appropriate, inoffensive, or beneficial; that the service will be uninterrupted, timely, secure, or error-free; or that any defect will be corrected.

Limitation of Liability

To the maximum extent permitted by applicable law, neither we nor our affiliates, employees, or service providers will be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the App — including emotional distress, lost profits, lost data, or loss of goodwill — under any theory of liability, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims under these Terms will not exceed the greater of: the amount you actually paid for the App in the twelve (12) months preceding the claim, or TBD: floor amount, e.g. USD 100.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. In those jurisdictions the limitations above apply only to the extent permitted, and nothing here affects mandatory consumer rights you have under local law.

Indemnification

You agree to indemnify and hold us harmless from any third-party claim, loss, liability, and reasonable expense (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your unlawful use of the App or use that infringes a third party's rights; or (c) Your Content.

App Store Terms (Apple)

• These Terms are between you and us, not with Apple Inc. ("Apple"). We alone are responsible for the App and its content, maintenance, and support; Apple has no such obligation.
• Apple provides no warranty for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation.
• We, not Apple, are responsible for addressing product liability claims, legal compliance, intellectual property infringement claims, and user complaints relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you as a beneficiary.

Governing Law and Disputes

TBD: governing law, venue, and dispute resolution mechanism (courts / arbitration / class-action waiver) — to be set by counsel based on the operating entity's jurisdiction and primary markets.

Nothing above affects mandatory consumer rights available to you under the law of your place of residence that cannot be waived by agreement.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page, and for material changes we will give advance notice in the App or by email. Continued use of the App after the changes take effect constitutes acceptance. If you do not accept the updated Terms, stop using the App and delete your account.

Miscellaneous

• Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in effect.
• No waiver. Our failure or delay in exercising a right is not a waiver of that right.
• Entire agreement. These Terms together with the Privacy Policy are the entire agreement between you and us regarding the App.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or transfer of assets.
• Language. This page is provided in Chinese and English. TBD: which version controls in case of conflict (to be decided by counsel).
